DO NOT ENTER THIS SWEEPSTAKES IF YOU ARE NOT LOCATED IN THE 50 UNITED STATES OR DISTRICT OF COLUMBIA AND ARE NOT 18 YEARS OF AGE OR OLDER.

PROMOTION PERIOD: Nestlé USA (“Sponsor”) will be conducting the 2013 “Share the Joy of Reading” Sweepstakes, beginning at 12:00:01 a.m. ET on 3/29/13 and ending at 11:59:59 p.m. ET on 3/26/14 (“Promotion Period”). There will be a total of four (4) sweepstakes periods (each a “Sweepstakes Period”) during the Promotion Period. See Sweepstakes Period chart below for dates and details.    

 

PROMOTION CODE: Look for a Promotion Code inside specially marked packages of NESTLÉ^® CRUNCH^®, BUTTERFINGER^®, BABY RUTH^®, 100 GRAND^®, BUTTERFINGER^® CRISP, NESTLÉ^® CRUNCH^® CRISP, WONKA^® LAFFY TAFFY^®, NERDS^® and SWEETARTS^® fun size, minis and mix-up bags and 6- and 12-packs. Each valid Promotion Code entered is valid for one (1) entry into the then-current Sweepstakes Period. For FREE entry without a Purchase/Promotion Code, see Mail-In entry section below. 

 

For each valid Sweepstakes entry properly received, as described below, Sponsor will make a $.10 donation to Reading Is Fundamental, up to a maximum of $250,000. In the event the amount of the donation is less than $100,000, Sponsor will make a minimum guaranteed donation in the amount needed to reach $100,000.

 

THERE ARE TWO (2) METHODS OF ENTRY:

 

1. Online Entry: Log on to www.celebrationcorner.com/rif (“Web site”) during the Promotion Period and follow the on-screen instructions to register and enter your Promotion Code. All online entrants must have a valid e-mail address to enter. Each person may use only one (1) e-mail address to participate in this Sweepstakes, and such e-mail address may be used by only one person regardless of whether the e-mail address is shared by two or more people. Any participant who uses more than one (1) e-mail address to enter this Sweepstakes may be disqualified and any prizes won may be forfeited subject to Sponsor’s sole discretion. In the event of a dispute as to the identity or eligibility of a potential winner who has entered online, the entry will be declared made by the registered user of the e-mail address used to enter the Sweepstakes. The “registered user” of an e-mail address is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Limit one (1) online entry per person, per day. A “day” is defined as the twenty-four (24) hour period beginning at 12:00:01 a.m. ET and ending at 11:59:59 p.m. ET each calendar day during the Promotion Period.

 

2. Mail-in: To enter for FREE without a Purchase/Promotion Code, hand print your name, home address (no P.O. Boxes) and birth date on a 3” x 5” card, and mail it in an envelope to: 2013 “Share The Joy Of Reading” Sweepstakes, P.O. Box 639, Basking Ridge, NJ 07920. Limit one (1) entry per postmarked outer envelope. Mail-in entries must be postmarked and received by the dates stated in the chart below to be eligible for the corresponding Sweepstakes Period. Mail-in entries must be handwritten. No mass or mechanical reproductions of 3” x 5” card will be permitted. Sponsor is not responsible for lost, stolen, illegible, incomplete, postage-due, misdirected or late mail-in entries.

WINNER SELECTION: Potential winners will be randomly selected from all eligible entries received for each Sweepstakes Period approximately three (3) weeks after the Entry Period end date. Nonwinning entries from each Sweepstakes Period will not be carried over into subsequent Sweepstakes Period(s). Potential winners will be notified at the mailing address/e-mail address provided at the time entry. All winners are subject to verification of eligibility and compliance with these Official Rules. Potential winners (their parents/legal guardians if residents of a jurisdiction that deems them to be minors) may be required to sign a Winner’s Agreement and Release and return it by date specified, or prize will be forfeited in its entirety. If a potential winner does not respond within the time specified in the winner’s notification, the prize will be forfeited in its entirety and an alternate winner may be selected from the applicable Sweepstakes Period entries. Return of any prize or notification as undeliverable will result in disqualification and an alternate winner may be selected. By accepting a prize, winner (his/her parent/legal guardian if he/she is a resident of a jurisdiction that deems him/her to be a minor) agrees to allow the use of his or her name, likeness, and/or biographical information for promotional purposes, except where prohibited.

 

PRIZES/ODDS: There will be a total of forty (40) Grand Prizes and four hundred (400) First Prizes awarded during the Promotion Period; ten (10) Grand Prizes and one hundred (100) First Prizes per Sweepstakes Period. Each Grand Prize winner will receive a $500.00 gift card (ARV $500.00). Gift cards are subject to federal and state regulations and the terms and conditions of the issuer. Each First Prize winner will receive a coupon good for one (1) free (up to $3.99) 9.2–14-oz. bag of any NESTLÉ^® or WONKA^® candy (ARV $3.99). Odds of winning a prize depend on the number of eligible entries received for each Drawing. Limit one (1) prize per person, household or address throughout the entire Promotion Period. Prizes are nonrefundable and nontransferable, except at the sole discretion of Sponsor. Sponsor reserves the right to substitute a prize of equal or greater value. All prizes are awarded AS IS. Federal, state and local taxes, if any, are the sole responsibility of each winner. Please allow 6–8 weeks after verification for delivery of prizes. Any depictions of prizes are for illustrative purposes only. Total ARV of all prizes $21,596.

 

ELIGIBILITY: Sweepstakes is open to legal residents of the 50 United States and D.C., 18 years and older, except employees and the families of Nestlé USA, Inc., Reading Is Fundamental, and each of their respective shareholders, employees, parents, directors, officers, affiliates, representatives, agents, successors and assigns, and each of their affiliates, subsidiaries and agencies. By participating in this Sweepstakes, you agree and acknowledge to be bound by these Official Rules; to waive any rights to claim ambiguity with these Official Rules, and that Nestlé USA, Inc., Reading Is Fundamental, and their affiliated companies, representatives, agents or employees (“Released Parties”) are not responsible for, and you release, hold harmless and indemnify such Released Parties for, any claims, injuries, losses or damages of any kind (including, but not limited to, liability for any property loss, damage, personal injury or death) resulting from or in connection with: human error; incorrect or inaccurate transcription of entry information; acceptance, use, misuse, possession or loss of the prize, and/or defects of the prize(s) awarded herein; or your participation in the Sweepstakes, even if caused by the negligence of Sponsor. Void where restricted or prohibited.

 

OTHER CONDITIONS: By participating in the Sweepstakes, each entrant (his/her parent/legal guardian if a resident of a jurisdiction that deems him/her to be a minor) agrees that the Released Parties shall not be responsible or liable for: (i) Promotion Codes, entries, or Winner’s Agreements and Releases that are late, forged, destroyed, lost, misplaced, stolen, misdirected, tampered with, mutilated, illegible, unreadable, unintelligible, incomplete, deleted, damaged, postage-due, or otherwise not in compliance with these Official Rules, and all such Promotion Codes, entries and/or Winner’s Agreements and Releases will be disqualified or void; (ii) human error; (iii) incomplete transmission defaults or faulty network connections, telephone, computer server/system/software failure of any kind; (iv) delayed, garbled or corrupted data; (v) any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any e-mail or players on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to Entrant’s or any other person’s computer related to or resulting from participation in, uploading or downloading any materials for this Sweepstakes; and/or (vi) any interruptions in or postponement, cancellation, or modification of the prize or Sweepstakes. Any attempts by an individual to access the Sweepstakes or Web site via a bot script or other brute-force attack will result in that IP address becoming ineligible. Sponsor reserves the right to modify, suspend, or terminate (in whole or part) this Sweepstakes and/or the prizes, if, in Sponsor’s sole discretion, the Sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Released Parties, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, or for any reason Sponsor deems it necessary. In such event, Sponsor/judges will select the winners by means of a random drawing comprised of all eligible, salvageable Promotion Codes or entries received during the Sweepstakes Period prior to (and/or after, if appropriate) the action taken by Sponsor or by some other means deemed by Sponsor in its sole discretion to be fair, appropriate and consistent with the spirit of these Official Rules. Sponsor shall have no liability for, and any Promotion Code or entry, winner notification, or promotional material will be automatically void if it is determined to be a mass entry or electronically reproduced, forged, altered or tampered with in any way, or if it contains programming, printing, typographical or other errors, incorrect or inaccurate information, or if it is obtained outside authorized channels. Sponsor reserves the right to terminate/cancel the Sweepstakes as a result of any printing errors. By entering this Sweepstakes, you (your parent/legal guardian if resident of a jurisdiction that deems you to be a minor) accept and agree to be bound by these Official Rules and the decisions of (as well as the interpretation of the Official Rules by) the Sponsor/judges, which shall be final. Sponsor reserves the right at its sole discretion to disqualify any individual it (or the judges) find(s) to be tampering with the entry process or the operation of the Sweepstakes or Web site, to be acting in violation of the Official Rules or any laws, or to be attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, misappropriation, infringement or any other unfair or disruptive playing practices/poor sportsmanship, or intending to annoy, abuse, threaten or harass any other entrants, person, entity or Sponsor representatives. ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to entrants.

 

DISPUTE RESOLUTION/CHOICE OF LAW: By participating, entrants agree that: (i) any claim, dispute or cause of action regarding the Sweepstakes or these Official Rules shall be brought individually (NOT AS PART OF A CLASS ACTION) in California State Court in Los Angeles County, California, or in Federal Court in the U.S. District Court for the Central District of California; (ii) they consent to the personal jurisdiction of such courts as the exclusive tribunal for adjudication of any such claim/dispute/cause of action; (iii) their recovery will be limited to actual out-of-pocket costs involved in participating in the Sweepstakes (if any) and they expressly waive their right to all other forms of recovery, including by way of example only, punitive, consequential, indirect, incidental, special and exemplary damages, as well as attorneys’ fees for bringing such claim/dispute/cause of action; and (iv) the court shall apply the law of the State of California in adjudicating any such claim/dispute/cause of action, except for the choice of law/conflict of law rules of California (or of any other jurisdiction that would result in the application of the law of any jurisdiction other than California).
